Understanding Charter Values

Description
The Supreme Court of Canada has held that even where a Charter right is not engaged, a decision must take into account “Charter values” in order to withstand judicial scrutiny. Recently adopted in Nova Scotia, Commission scolaire francophone des Territoires du Nord-Ouest v. Northwest Territories (Education, Culture and Employment), 2023 SCC 31 raises many questions about how these unwritten constitutional values impact decision-making. This session will explore the SCC decision, discuss Charter values, outline implications for administrative decision-making, and share strategies for compliance.
