How can courts determine whether an administrative decision-maker has displayed bias in rendering a decision? In the recent case of Kiann v HRM, 2024 NSSC 305, the Nova Scotia Supreme Court weighed in on this question, finding that two HRM councillors displayed a reasonable apprehension of bias that warranted the Court’s intervention on judicial review.
