Increasingly, evidence that is relevant to a criminal proceeding is held by American service providers. This session will discuss the legal issues and caselaw related to seeking evidence from the US, including relevant American laws and the likely effect of the CLOUD Act agreement being negotiated between the two countries.

David Fraser, McInnes Cooper
David Fraser is a partner with McInnes Cooper in Halifax and the vice chair of the Privacy and Access Law Section. His practice focuses on internet and privacy law. He regularly advises non-Canadian businesses that operate here, both with a physical presence or virtually. He regularly advises companies in connection with requests for customer and user data by law enforcement, and in connection with civil matters.
