An overview of R v Montour & White: A new approach to section 35 rights?

Description

On November 1, 2023, the Quebec Superior Court released a decision that addresses some of the fundamental flaws in the jurisprudence interpreting section 35 of the Constitution Act, 1982. This decision explains that UNDRIP is binding and should serve as the minimum standard for Courts interpreting section 35 rights. The Court not only set out a new test for Aboriginal rights that is rooted in Indigenous law, but says that all Indigenous Nations have a right to freely pursue economic development.
