An Introduction to Indigenous Rights in Real Property


Indigenous property rights can impact real estate transactions coast to coast. Indigenous land title differs significantly from freehold tenure. On-reserve conveyancing and financing present an entirely novel vocabulary and statutory framework to the uninitiated. Likewise, Indigenous legal and treaty rights may impact off-reserve land, requiring practitioners in the civil or common law system to identify and address client risks in the course of a transaction. This course aims to give general real estate practitioners an essential and practical primer on Indigenous real property rights.

Topics will include:

  • Introduction to regimes of property systems
  • Off-reserve: duty to consult, archaeology, access and additions to reserve
  • Tsilhqot'in decision in context: impact of claims and treaties on private land
