In June 2024, the Canadian government amended the Competition Act to include structural presumptions based on a prescribed concentration index. Comparatively, U.S. authorities consider the concentration index as part of non-binding guidelines. With the amendments in force for nearly one year, this panel explores the practical impact of the structural presumption to date, what this means for future merger reviews, and implications for how businesses and their advisors are navigating these developments.
