Join three CBA sections on this collaborated symposium discussing current issues arising from a Power of Attorney. Sessions will be focused on interprovincial drafting differences, Quebec’s Civil Code, using powers of attorney with investments, litigation issues surrounding powers of attorney including enforcement, and best practices in advising an appointed power of attorney.

SESSION 1: Powers of Attorney Across Canada : Tips and Traps in Drafting
The first session will focus on Powers of Attorney Across Canada and panelists will provide interprovincial nuances, along with drafting tips and traps depending upon the Province. A Quebec panelist will also discuss what you need to know about the Quebec Protection Mandate, as well as what happens when a Mandate is not in place.

SESSION 2: Power of Attorney and Investments
The second session will focus on Powers of Attorney and Investments. A Panelist will discuss the obligations and duties of a Power of Attorney when it comes to investments, the transitions of investments, and the role of investment counsel. An informative discussion about the Canadian Bankers Association's resources and initiatives will follow, including the Commitment on Powers of Attorney and the Code of Conduct for the Delivery of Banking Services to Seniors. A Q&A session will provide an opportunity to take questions live from attendees.

SESSION 3: Powers of Attorney and Litigation
The third and last session will focus on Powers of Attorney and Litigation. Panelist will discuss recent cases notably throughout Canada and will provide a practice pointer checklist. A special focus on litigation involving investments, beneficiary designations, Administrator / employer responsibilities, and spousal entitlements will be discussed before closing out the day with an in-depth discussion on educating your client to prevent litigation. Panelist will include best practices regarding Acknowledgements and Reporting requirements.
