SESSION 1: The Application of Proprietary Estoppel across the Country and Practice Areas
This panel, comprised of an estate litigator from British Columbia, a family lawyer from Ontario, and a commercial litigator from the Maritimes, reviews case law developments in the application of proprietary estoppel since the 2017 Supreme Court of Canada's decision in Cowper-Smith v. Morgan. Participants will form a strong understanding of the elements of proprietary estoppel and where it may be used in practice, including its application to a variety of property interests across practice areas.

SESSION 3: Engagement of Experts in Civil Litigation
This panel, composed of three speakers from across Canada, will discuss circumstances wherein counsel should consider retaining an expert to provide opinion evidence on a central issue outlined in the pleadings and how to properly and effectively instruct an expert to maximize the value of that expert’s opinion in a report. This speaker panel will focus on various different types of experts to consider, including medical experts in the context of personal injury actions or otherwise, property appraisal experts in real property disputes, and economic experts in the context of commercial litigation claims. Participants can expect to hear examples of circumstances where an expert would be helpful, what makes a strong expert report, and how to navigate properly instructing an expert to avoid challenges to the credibility or appropriateness of the expert’s findings.
