Please join Justice Johanna Price from the Alberta Court of King's Bench, and Justice Kent Teskey, from the Alberta Court of King's Bench along with leading practitioner, James Casey, KC in an interactive session discussing the test for assessing the truthfulness of competing evidence in both the civil and criminal contexts. What's the difference between credibility and reliability? What are best practices for judges to follow in analyzing and reconciling competing evidence at trial? What unique factors are applicable in criminal matters, particularly in sexual assault matters? What are the issues that will create the risk of appellate intervention? What grounds are most commonly relied upon by appellate courts to reverse decisions of trial courts based on credibility findings and how can these “traps” be avoided? These key principles will be discussed by our distinguished speakers to assist you with managing these important issues at trial.
