Green Claims: Materiality, Efficiencies and Other Considerations

The Marketing Practices and Economics and Law Committees have combined to bring together a panel that will discuss two important and timely topics related to green claims.
First, consumer protection law has long considered the materiality of price on consumers in making purchasing decisions. However, increasingly non-price considerations are being taken into account, particularly claims related to the environment, climate and sustainability. The panelists will discuss emerging tools in behavioural economics to help review and analyze the materiality of “green” claims on consumer decision-making.
Second, since non-price effects can have impacts beyond traditionally defined product and geographic markets, antitrust agencies are starting to consider not only the consumers who are directly affected by the parties’ actions, but also the overall impacts on society and future consumers. The panelists will discuss how sustainability issues are emerging as a defence in merger, cartel and other antitrust cases.
