In the Competition Act’s current form, only the Commissioner may bring an application to the Tribunal challenging conduct under section 79 of the Act. Attend this session to hear the views of seasoned practitioners and Bureau personnel on what makes an effective (or ineffective) complaint under section 79 of the Act. Topics that will be explored include: the different complaint avenues available (informal or a section 9 application) and successful theories of harm; the evidence required for a successful complaint; preparing for a Bureau investigation and inquiry (including potential use of section 11 powers); and staying apprised of the Bureau’s investigation.
