Plaintiffs have recently been beset by a number of adverse decisions on certification: Jensen v. Samsung, Maginnis v. FCA Canada, Latifi v. The TDL Group, Mohr v. NHL, and David v. Loblaw. Each raise important points of interest for competition law advisors as well as litigators.
