Plaintiffs have recently been beset by a number of adverse decisions on certification:  Jensen v. Samsung, Maginnis v. FCA Canada, Latifi v. The TDL Group, Mohr v. NHL, and David v. Loblaw. Each raise important points of interest for competition law advisors as well as litigators. Some provide clarification in developing areas of the law, while others exemplify persistent confusion regarding certain aspects of the certification test. 

Our panel will review the most notable aspects of these recent decisions, and consider their implications for future cases.
