What is Happening with Injunction Jurisprudence at the Competition Tribunal?

The past year has seen three injunction decisions made in the Secure/Tervita case – two made by the Tribunal and one by the Federal Court of Appeal. While the jurisdictional question raised by the first decision has now been resolved, other issues remain.
Our panel will consider strategic questions, including the particular challenges posed when relief is sought on relatively short notice.
It will also examine the substantive standards and the evidence needed to meet the Tribunal’s “strong prima facie case” standard, and consider the distinction between mandatory and prohibitory injunctions.
