1:00 pm - 3:00 pm Legal Implications of Extra-Judicial Remedies
The session will first look at the legal consequences of civil disobedience when all else fails from the perspective of three lawyers: one familiar with the TransMountain Pipeline protests and KI protests in Ontario, one involved in the Muskrat Falls protests in Newfoundland and Labrador and the third a professor on the impact of the recent Alberta anti-protest legislation on Indigenous rights (45 minutes).

The second session will first look at how it is possible to exercise a Treaty or Aboriginal right by “just doing it”, using the Sipekne’katik First Nation moderate livelihood fishery launch in 2020 as an example. The violent response of the non-Indigenous fishers and the community’s legal proceeding to hold RCMP accountable for failing to protect the moderate livelihood fishery will also be discussed (30 minutes).

The session will end with a panel of 3-4 Indigenous leaders speaking about and discussing their experiences with judicial and extrajudicial remedies (45 minutes).
