This panel will review recent developments relating to frivolous and vexatious requests in the information and privacy context including: 

  • An update from the Information Commissioner’s Office on the application of the new power to grant approval to government institutions to decline to act on an access request that was introduced with the passage of Bill C-58; 
  • Developments within Alberta Courts regarding vexatious litigant orders that include limitations on access to non-judicial bodies including the Alberta OIPC; 
  • The impact of frivolous and vexatious requests on public bodies; and 
  • Observations based on the Ontario Commissioner’s review of institutional decisions to disregard requests the institution has determined to be frivolous or vexatious.
