The Impact of COVID-19 on Merger Control

The panel will consider the effect that COVID-19 is having and is expected to have on merger control in Canada and internationally and consider, among others, the following topics:
- The effect that the pandemic will have on the timing of reviews and service standards
- Potential strategies that can be employed by parties to facilitate a more efficient review to mitigate potential delay
- Whether antitrust regulators should relax information requirements for certain types of transactions during this time
- The effect the pandemic may have on substantive reviews (e.g., increased reliance on failing firm arguments)
- Whether there is expected to be increased use of timing agreements to allow regulators additional time to complete their substantive reviews
- The increased complexity of coordinating global reviews of transactions among regulators
- The challenge of determining the "but for" world against which to assess competitive effects where historic data may give little guidance as to the future
