“Charter Statements”

Since April 2016, the Minister of Justice has been tabling a “Charter Statement” in Parliament for every bill sponsored by the Minister, as well as for a number of other Government bills. These Charter Statements outline some of the key considerations that inform the review of a proposed bill for inconsistency with the Canadian Charter of Rights and Freedoms, with a view to informing public and parliamentary debate. Legislation currently before Parliament would make the Minister’s existing practice a legal duty.
The presentation by Counsel in Justice Canada’s Human Rights Law Section will provide context and information about the evolving practice of Charter Statements, and allow for consideration and discussion of the public and parliamentary benefits of these Statements.

Élène Bérubé has been Counsel in the Department of Justice Canada’s Human Rights Law Section since 2007, where she specializes in the right to equality, fundamental freedoms and international human rights law. Élène has previously worked with a civil society organizations in Guatemala, and with the UNHCR in Malawi. She has a LL.B. from the University of Ottawa, and a Master’s of Arts in International Affairs from Carleton University.
