Litigating For and Against the Bureau

Is competition litigation really different from other types of civil litigation? (Hint: The answer is “Yes!” or we wouldn’t have a brown bag about it.) The Commissioner of Competition is a unique party – whether as an adversary or as a client – and the Competition Tribunal has special features and processes that are unlike those of courts.
Bringing their perspectives and experiences from both sides of cases, our panelists will discuss these special considerations in the context of litigating reviewable matters. What are the Bureau’s distinctive characteristics and how should they affect counsel’s approach? How will proposed improvements to the Tribunal’s processes affect the path of competition litigation?
Finally, our panelists will compare the Canadian and American approaches to merger litigation, with a focus on the Staples – Office Depot case, in which two panelists experienced the FTC’s injunction process from opposite sides.
