TOPIC: Part II – Powers of Attorney - Duties and Obligations

In this second session of our three-part series, seasoned litigators will present on an attorney's obligations under the Act and at common law, dealing with a misbehaving attorney including remedies and sanctions, setting aside a POA for undue influence, advising the attorney including on providing his/her accounting and removing or replacing attorneys.

Our final session will cover more in-depth issues such as an attorney's ability to do estate planning for the donor and reporting/accounting at the time of donor's death, financial and banking reporting requirements, tax barriers and other obstacles facing foreign individuals acting under POA. We will also cover joint accounts and offer the perspective of a major bank (retail and investing) on its experience with joint accounts and persons acting under POA, how they approach jointly held assets and why.

TOPIC: Part I – Powers of Attorney - The Basics

For those just starting in this area, who want a refresher or to improve their knowledge of basic POA issues, this first session will cover why powers of attorney are so crucial, drafting tips, what an attorney can and cannot do, attorney compensation, capacity issues, and advising the attorney. This is the first of a three-part series.
Attendance at these MBA meeting can be applied towards your Law Society of Manitoba's Continuing Professional Development for a maximum of 4.5 hours (1.5 hours per session).
