Synopsis
Emily L. Clough discusses the tools and legal avenues that are available to counsel dealing with predatory relationships.
Topics include:
- Protecting incapable adults by commencing a committeeship proceeding;
- Invalidating power of attorney and other incapacity planning documents made by incapable adults;
- Protecting incapable adults in predatory marital relationships; and
- Preventing and reversing gifts made by incapable adults.
Speaker Bio
Emily L. Clough is the Managing partner at Clark Wilson LLP, one of Western Canada’s largest law firms. She has acted as counsel in cases that have set new precedents in BC, including on wills variation and the incapacity to marry. Her cases have received national coverage by the Globe & Mail and the CBC. Emily is also a sought-after author and speaker, routinely presenting at conferences on elder law and incapacity matters and writing new chapters for the Continuing Legal Education Society of BC’s estate-related publications.
