Synopsis
Stephen McPhee, KC, discusses the essential role of Independent Legal Advice (ILA) in mediations, highlighting the risks and obligations for mediators and parties when ILA is lacking. His presentation covers the BC Supreme Court's decision in Spanell v. Spanell and Section 93 of the Family Law Act, providing insights into the legal implications of inadequate ILA.
About the Speaker
Stephen is an experienced Family Law practitioner and Med/Arbitrator and managing partner at RLR Lawyers. Stephen has always had a strong interest in ADR and Collaborative Family Law. He has been the chair of the CBA Nanaimo ADR subsection at various times since 2004. He achieved the Conflict Resolution Certificate from the Justice Institute of BC in 2000 and is a Law Society of BC accredited Family Mediator and Arbitrator.
