Synopsis
Michael Welsh discusses potential practice consequences of the new Legal Professions Act for lawyers, notaries and licensed paralegals. While the Act currently states that notaries can draft certain types of wills but not estate administration, the government can, by regulation, change the scope of practice as can the new regulator. With respect to licensed paralegals, the Act allows government to set scopes and areas of practice by regulation and to set classes of paralegals with different scopes of practice of law. Welsh expands on the potential consequences of government taking control of determining scopes of practice for legal service providers.
Welsh also highlights the threats to lawyer independence that form the basis of the constitutional challenges to the Act currently being brought by the Law Society and the TLABC.
