Synopsis
The Ontario Superior Court has recently pronounced judgment in a case arising out of the downing of Ukrainian International Airlines flight PS752 shortly after departure from Tehran Imam Khomeini International Airport on January 8, 2020. The Court found that UIA was negligent and its liability was not limited by the Montreal Convention.
Jamie Thornback, one of the counsel for the plaintiffs, explains this decision and the important legal and factual issues dealt with during the trial and in the judgment.
