About Kevin D. Loo, KC
Kevin D. Loo, K.C. is an experienced and trusted trial and appellate lawyer. He has been a partner of NST since 2001 and was appointed King's Counsel in 2021. He has been recognized annually since 2016 by Best Lawyers Canada in the field of corporate commercial litigation and by Benchmark Canada as a Litigation Star. He is a Fellow of the Litigation Counsel of America.
Kevin practices in the areas of commercial litigation, and bankruptcy and insolvency. In his commercial litigation practice, he has successfully represented both corporate clients and individuals in a wide range of business disputes, such as breaches of contract, class actions, disputes arising from real estate and lease transactions, commercial fraud, professional negligence, claims among partners and shareholders, and claims arising from franchise and dealership agreements. His bankruptcy and insolvency practice involves advising and representing debtor companies, secured and unsecured creditors, and other parties involved in business insolvency proceedings.
Kevin regularly appears as counsel in the B.C. Supreme Court and Court of Appeal. He has appeared in the Supreme Court of the Northwest Territories, in the trial division of the Federal Court, and before various administrative tribunals. He consistently contributes to continuing legal education in British Columbia, by writing articles and presenting at courses and conferences.
Kimberly Henders Miller
After a short career in genetic research, Kimberly Henders Miller attended UVic Law School, graduating in 1999. She has been with the BC Prosecution Service, since shortly after her Call in 2000. She began her career as a trial Crown in the Victoria Crown Counsel office, then progressed to Administrative Crown, and eventually Senior Trial Crown in the Western Communities and Victoria Crown Counsel offices. She is the Team Lead on a Major Case team on a complex murder prosecution, and has recently become Deputy Regional Crown Counsel for Central Vancouver Island.
She is currently the President of the Victoria Bar Association, and Vice Chair of the CBABC Women’s Law Forum, Vancouver Island. Since 2019, she has been a member of the Law Society Hearing Panel Pool. She was Co-Chair of the CBABC Criminal Justice Section for many years and has served as Provincial Council Victoria County Rep and on other CBABC Committees.
Yarden Gershony
Yarden’s practice is devoted to complex commercial litigation, arbitration, and other forms of alternative dispute resolution. Yarden practiced in the Vancouver office of McCarthy Tétrault and is now a partner at Rush Ihas Hardwick LLP, the leading commercial litigation firm in the BC Interior.
Yarden handles disputes concerning real estate assets, breach of contract, shareholder remedies, construction disputes, breach of trust and fiduciary duty, and financial fraud and misappropriation. He also regularly advises clients on disputes in the legal cannabis industry. His broad-based practice extends to representing clients in trials, judicial reviews, appeals, mediations, arbitration hearings, and administrative hearings. He is a member of the Bars of British Columbia and New York.
Yarden also acts arbitrator in commercial disputes throughout British Columbia. He is a registered arbitration panelist (expedited procedure) with the Vancouver International Arbitration Centre (VanIAC).
Prior to commencing his practice in British Columbia, Yarden practiced for four years in the New York office of Shearman & Sterling LLP, a prominent global firm. In that role, Mr. Gershony appeared before numerous state and federal courts at the trial and appellate levels, including via written argument before the United States Supreme Court. As arbitration counsel, Yarden has acted in large disputes under the ICC rules seated in London and Paris. In that capacity, Mr. Gershony was a core member of the legal team that won—and collected, in full—the then-largest arbitration award in history (USD 2.5 billion) in The Dow Chemical Company v. Petrochemical Industries Co. of Kuwait.
