Synopsis

Join Chief Justice Robert Bauman, Registrar Timothy Outerbridge and Legal Counsel Shirley Smiley for a panel discussion on modified court operations in the Court of Appeal. Since mid-March, the courts have significantly modified operations in response to the COVID-19 pandemic. Beginning May 4th, the Court of Appeal will hear all appeals by video-conference, chambers applications and registrar’s appointments will proceed by teleconference, and e-filing becomes mandatory for civil appeal.

In this panel discussion, you will hear directly from the Chief Justice regarding the court’s commitment to continuing operations in the ”new normal”, you will also hear from the Registrar and Legal Counsel about the important procedural steps that accompany these significant changes, and lessons learned during the first week of video-conference appeal hearings.

Time will be reserved to answer questions.  

 

About Chief Justice Robert J. Bauman

The Honourable Robert J. Bauman is the Chief Justice of British Columbia, Chief Justice of the Court of Appeal for British Columbia and Chief Justice of the Court of Appeal of Yukon.

He was appointed as a justice of the Supreme Court of British Columbia in 1996; as a justice of the Court of Appeal for British Columbia in 2008; as Chief Justice of the Supreme Court of British Columbia in 2009; and as Chief Justice of British Columbia in 2013. Prior to becoming a judge, he was in private practice with Bull, Housser & Tupper in Vancouver. He worked largely in the areas of local government and administrative law. While practicing law, he taught administrative law at the University of British Columbia Faculty of Law as an adjunct professor from 1991 o 1996.

In 2012, and again in 2013, Chief Justice Bauman was named by Canadian Lawyer Magazine as one of the “Top 25 Most Influential” in the justice system in Canada. In 2012, he was also presented with the Queen Elizabeth II Diamond Jubilee Commemorative Medal for contributions to Canada. As well, Chief Justice Bauman is the 2012 recipient of the Anthony P. Pantages, QC Medal for outstanding contributions to the field of justice, presented by The Justice Institute of British Columbia Foundation. Chief Justice Bauman was the recipient of the 2013 TLABC Bench Award by the Trial Lawyers Association of British Columbia. From 2013 to 2016, he held the position of Vice-Chair of the Canadian Judicial Council. Chief Justice Bauman is the founding Chair of Access to Justice BC.

He has given back tremendously to the legal community, as a member of the Provincial Attorney General Rules Committee, chair of the Supreme Court civil law committee, chair of the CBA Municipal Law Section, and a panellist at Continuing Legal Education. He also lectured at BCIT and was an adjunct professor of administrative law at UBC.



About Tim Outerbridge

Tim Outerbridge became the Registrar of the British Columbia Court of Appeal in June 2014. 

After receiving his J.D. Law from the University of Alberta in 2004, Tim joined Field LLP as an articling student and then associate lawyer where he practised health and professional regulatory law. In 2006, he joined Alexander Holburn Beaudin & Lang LLP as Associate Lawyer & Research Director praciticing litigation, appellate law and legal research. In addition, he coordinated the ASCEND™ in-house Continuing Legal Education training program for lawyers and articling students.Tim also worked with the firm's Appeal Advisory Team, conducting and assisting clients with appeal of all kinds to various tribunals and appellate Courts of Canada.

Before his role as Registrar, Tim was appointed as Legal Counsel to the British Columbia Court of Appeal in 2011. He worked as legal counsel to the Chief Justice of British Columbia, providing advice and direction on legal and administrative questions to the Chief Justice, the Registrar, and the Court of Appeal's various Committees. Tim also supervised the Law Clerk program and acted as the Court's principal contact with the media.

In his role as Registrar, Tim performs judicial and quasi-judicial functions, including conducting registrar’s hearings, assessments and other matters set out by statute or the Rules of Court or referred by a judge of the Court of Appeal. Tim also manages the Office of the Registrar and provides legal, technical and procedural direction to the Deputy Registrars and provide oversight to the Registry and its staff.



About Shirley Smiley

Shirley Smiley was appointed as Legal Counsel for the Court of Appeal for British Columbia in January 2019.

After receiving her J.D. of Law at The University of British Columbia in 2011, Shirley became an articling student at the Department of Justice B.C. Regional Office focused on aboriginal law litigation and advisory groups where she also completed rotations with the Public Prosecution Service and the Business and Regulatory litigation sections.

In March 2013, Shirley took on the role of Legal Counsel at Department of Justice British Columbia Regional Office in Vancouver. She provided comprehensive litigation service to a variety of client departments as junior counsel on complex litigation files involving Charter challenges, aboriginal fishing rights, and regulatory negligence. She was also lead counsel on files involving personal injury to Federal employees, regulatory negligence, misfeasance in public office, and various judicial reviews.

Shirley became the Research Lawyer for OnPoint Legal Services in November 2016 where she provided top-quality research, analysis, and writing services to lawyers in British Columbia, Alberta, and across Canada. 

Shortly after taking on the role of Legal Counsel for the Supreme Court of British Columbia in August 2017, the Court of Appeal for British Columbia welcomed Shirley Smiley as legal counsel for the Court effective January 21, 2019.
