
Who Owns Brine-Hosted Minerals in Alberta?

As carbon capture and storage projects advance through the regulatory approval process, Professor Bankes looks at concerns being raised by those with competing interests to those that hold pore space rights. In particular, those with mineral interests who claim that the injection of carbon dioxide into a formation will be prejudicial to their mineral interests because of the potential to impair recovery of brine-hosted minerals, specifically lithium, in the reservoir. But who actually owns brine-hosted minerals in Alberta? Professor Bankes questions the underlying assumption that mineral title actually includes brine-hosted minerals.
