Prenatal Harm and the Duty of Care

Presented by the CBA Alberta Health Law South Section

The case law makes it clear that physicians owe a duty of care to their pregnant patients and, at least in some circumstances, to the child yet-to-be born. But it also suggests that extreme caution is warranted with respect to extending the duty of care to the "unborn child" beyond the labour and delivery context. This talk will explore questions related to physician exceptionalism and the duty of care in relation to prenatal (and even preconception) harm.
