
The Competence-Competence Principle for Litigators

Following the SCC’s decision in Peace River and Uber, there is a growing amount of caselaw on the competence-competence principle. While an arbitrator can decide his/her own jurisdiction, in practice this issue often comes before a Court at first instance and the parties and the Court must grapple with the exceptions.
