Abusive, Frivolous or Vexatious FOIP Applicants - Tips and Strategies

When is an access request under the Freedom of Information and Protection of Privacy Act (“FOIP”) an abuse of the access rights under that Act? Section 55 of FOIP provides a process for public bodies to disregard a request in certain circumstances if the request is repetitious, systematic, frivolous or vexatious. Diane Alguire and Mary Golab will discuss cases and orders that consider when a FOIP applicant’s access request can be disregarded, and when a litigant’s application related to a FOIP access request will be determined to be frivolous, vexatious or abusive. In addition, they will set out some tips and strategies that can be used when dealing with challenging behavior in a FOIP applicant.
