"That’s not Covered!": Insuring Intent
Presented by the CBA Alberta Insurance Law North Section
On Demand. Originally presented on September 19, 2024.
Fortuity – the idea that a loss must be uncertain and unintended to attract coverage – is at the heart of insurance law. At the same time, insurance covers a range of intentional acts from negligent driving (when the driving itself is obviously intended) to explicitly intentional torts such as defamation, even though many policies that provide these coverages exclude “intentional acts” or losses “expected or intended” by the insured.
Join Professor Erik Knutsen of the Queen's University Faculty of Law for a new perspective on how to reconcile and apply these complex concepts to even the most challenging coverage questions.
Professor Knutsen is a recognized authority on insurance law and regularly consults with lawyers on cases heading to trial or appeal, including cases at the Supreme Court of Canada, American courts, and other courts and tribunals around the world. He is the author of Halsbury's Laws of Canada – Insurance and the co-author of Stempel and Knutsen on Insurance Coverage, one of the leading American insurance law treatises. Professor Knutsen is also a dynamic and engaging speaker whose ability to share his knowledge of and enthusiasm for insurance law has been recognized through many teaching awards.
