
The Mens Rea for Sexual Assault

More than 40 years after the offence of sexual assault was enacted, there remains significant confusion as to the basic elements of this offence. Paul M Alexander has been a working Crown Attorney for 25 years in Toronto. Based on work that started with preparation for a pre-charge conference on a sexual assault trial, he, along with Professor DeLuca, published an article on the mens rea for sexual assault called “The Mens Rea for Sexual Assault: How Jury Instructions Are Getting it Wrong” (2019) Man LJ 39. Mr. Alexander will present on that paper and comment on the subsequent jurisprudence.
