
The Standard of Care and Liability of Design Professionals

To ensure safe and healthy structures, the Alberta Edition of the National Building Code, and all Canadian building codes, sets out a host of duties and responsibilities for design professionals at both the design and construction phases. Design professionals develop the project specifications and drawings, review shop drawings prepared by contractors, and attend sites to review the construction in progress. In this talk, we explore the potential professional liability that may arise from each of these seemingly distinct tasks under the Alberta Safety Codes Act, which regulates the building code, and the Alberta Contributory Negligence Act. Representative cases will be put forward for analysis and discussion.
