Jason will discuss the most important regulatory investigation cases of 2023 and early 2024, the legal trends set, and the operational implications. Key topics will include: what disclosure requirements exist at the investigation stage of disciplinary proceedings; if a regulated member can challenge an investigation prior to the conclusion of a hearing; the duty to cooperate; factors in unfair or adequate investigations; challenging witness summons and information requests by judicial review and level of fairness owed.
