Counsel Involved in Supreme Court of Canada Hansman v Neufeld Decision Discuss its Significance for 2SLGBTQI+ Community and Beyond

The Canadian Bar Association Alberta (CBA AB) Sexual and Gender Diversity Alliance (SAGDA) (formerly known as SOGIC) invites you to a panel presentation on the Supreme Court of Canada’s (SCC’s) recent landmark transgender human rights and defamation law decision in Hansman v Neufeld, 2023 SCC 14. The Hansman decision was the first SCC decision to comprehensively consider the social context of transgender persons in Canada. The decision also made timely developments in the law of defamation, particularly the defence of fair comment, likely to benefit persons engaging in protective counter-speech against recent increases in harmful hate speech. The appeal’s context centered around a dispute between a school board trustee and teachers union and advocacy group president over 2SLGBTQI+ inclusive curriculum and provides insight on appropriate behavior for trustees and other public officials when discussing 2SLGBTQI+ persons and issues. The three counsel who were involved in this appeal will outline its background, issues raised, and the significance of the SCC’s findings for the 2SLGBTQI+ community and the wider public.
