Personal Liability in Workplace Litigation
Remedies in the employment law world are not always limited to the employer alone. Sometimes the law allows claims to extend to directors, owners, and other individuals. In this presentation, we will survey a number of emerging trends in the law that allow claimants to extend liability to individuals. We will examine the latest cases where tools like the oppression remedy have been used in the employment context to extend liability. We will look at the latest human rights decisions that have added individual parties as respondents to the proceedings and explore when tribunals may order individuals liable for employment-related human rights breaches.
