
Regulation of Toxic Substances: Forever Chemicals (PFAS) – A Persistent and Growing Concern

The presentation will discuss the current status of Canada’s regulation of Per- and polyfluoroalkyl substances (“PFAS”), the emergence of some of the first PFAS-related litigation in Canada and offer a brief look at recent developments in other jurisdictions. The presentation will also touch on recent amendments to the Canadian Environmental Protection Act, 1999, and their potential impact on the regulation of PFAS and other toxic substances moving forward. PFAS are a group of over 4,700 synthetic chemicals that consist of a fluorinated carbon chain. These substances are extremely stable and capable of repelling both heat and water. Consequently, PFAS have been widely used in a variety of household products and industrial applications for several decades. Unfortunately, PFAS are extremely persistent and largely incapable of being broken down in the environment by natural means, which is why they are often referred to as the “forever chemicals.”
