
Law and Odour: Special ‘Ick’tims Unit – Managing the regulatory hydra of a wayward compost facility
For more than a decade, the Cleanit Greenit compost facility in northwest Edmonton operated in contravention of a 2011 Alberta Environment and Protected Areas (AEPA) enforcement order, causing odorous impacts on surrounding communities and potential adverse effects on the environment. This presentation, from the two Alberta Justice lawyers who advised AEPA throughout the protracted history, will discuss the legal issues that had to be creatively navigated to resolve the many aromatic regulatory challenges arising from the file. The presentation will touch on the recent decision in Cleanit Greenit Composting System v Director (Alberta Environment and Parks), 2022 ABQB 582.
