Multi-step dispute resolution clauses have become common features in construction and infrastructure projects. In addition to becoming ubiquitous contractual terms, they have also become more complex. As a result, these clauses can create serious practical, procedural, and substantive challenges for counsel and clients alike. In this session, we examine the practical approaches to dealing with complex dispute resolution clauses from both a pre-dispute contract drafting perspective and a litigation perspective.
