Wake-up Call: Changes to Canada's Competition Law - How it will Affect You.

Last year the Canadian government, and Minister Champagne in particular, initiated a massive review of the Competition Act’s provisions to ensure they are modernized to meet the demands of the digital economy and are “fit for purpose”.  Proposed changes and 2022 changes cover a wide range of provisions in the Competition Act and represent the most significant overhaul of the Act in decades. A bill is currently before Parliament that would eliminate the efficiencies defence in mergers, compel companies to produce information for the Competition Bureau’s market studies and allow for civil review of agreements between customers and suppliers that have as a significant purpose the lessening or prevention of competition (e.g., restrictive covenants in leases). Other amendments are also in the works. What do these changes mean to you?
