
Simplicity in the Law of Judicial Review of Regulations: Auer and TransAlta
In 2018, it was estimated that delegated legislation (regulations, orders, and other subordinate instruments) were made at a 5-1 ratio in relation to primary law; that is, for every 1 law adopted by Parliament, 5 subordinate regulations were generated. This raises difficult questions about how Canadians are governed, and how courts, as guardians of the rule of law, should respond. One of these questions concerns how courts review delegated legislation, and the ongoing debate over that question. The big question: does Vavilov change things?
