
Indigenous Economic Interests and the Duty to Consult
Discussion of Ermineskin v Canada, 2021 FC 758, which granted an application for Judicial Review by Ermineskin Cree Nation arising from a Government of Canada decision to require a federal environmental impact assessment for a resource project. The Court found the Crown duty to consult was triggered by adverse impacts to Ermineskin Cree Nation's economic interests.
