
To JR or not to JR: litigating immigration refusals at the Federal Court
Highly experienced in immigration litigation, the presenter will share his approach to scrutinizing negative immigration decisions, identifying reviewable errors, assessing the merits of potential judicial review (JR), and preparing strong JR applications. Refusals of humanitarian & compassionate applications and negative PRRA decisions will be used as examples. Whether or not handling courtwork, every immigration practitioner should be equipped with the tools to assess the likelihood of success if contemplating JR litigation as recourse for a refusal and to formulate persuasive arguments. This presentation will facilitate developing or perfecting such tools for everyone practicing immigration law.
