
Canada's Climate Change Constitutional Conundrum: Reference re Impact Assessment Act.
The constitutionality of Canada's Impact Assessment Act will be tested before the Supreme Court of Canada in 2023. The reference is a symptom of a generational challenge facing our federation: how do we reconcile action on climate change and other environmental priorities with the protection of provincial jurisdiction over natural resources and electricity, local works and undertakings, and local economic activity. Professor Leach will examine how Canada sees its jurisdiction over effects within federal jurisdiction extending far into the traditional legislative ambit of the provinces and how Alberta (and the Alberta Court of Appeal) saw multiple aspects of this legislation as unconstitutional.
