A discussion of important “best practices” for companies to adopt to best avoid legal actions for infringement of third-party IP rights in Canada, and if sued, how to reduce to the extent possible any liability. Also discussed will be the “flip” side---- recommended things to do if your IP rights are infringed by third parties to not only increase your chances of success in having the defendant(s) found liable but to also maximize your recovery and remedies available if the defendant(s) are found to infringe. Decisions of the Federal Court of Canada trial and appellate divisions on certain of these topics will be discussed.
