ABOUT THE CONSULTATION

The Family Law Committee is preparing CBABC's submission to the BC Civil and Family Rules Committee on their consultation paper on access to family files, and wants to hear from you, members of the Privacy, Family Law and Children's Law Sections.

The Rules Committee is currently reviewing access to family files under Supreme Court Family Rule 22-8 – Searches. Concerns have been raised with respect to the privacy interests of children and the potential for inappropriate use of sensitive information within documents such as affidavits and other materials filed in family litigation. The consultation paper presents options for reform of access to family law files:

  • Change Rule 22-8 to restrict access to the entirety of family law files to parties and their lawyers

  • Change Rule 22-8 to restrict access to reports relating to children to parties and their lawyers

  • Do not change Rule 22-8

Register to share your views. If you can't attend one of these sessions, please email your thoughts to advocacy@cbabc.org by November 8 and your comments will be shared with the Family Law Committee.
